Hotel Workers Sue Staffing Firm For Potential Violations

Hotel workers in Indianapolis have sued staffing firm Hospitality Staffing Solutions and 10 hotels in Indianapolis for wage and hour violations.

If the lawsuit is certified as a collective action, the group could be entitled to as much as $10 million, according to Unite Here, a union representing the workers.

The workers allege the staffing firm and hotels failed to regularly pay them for hours worked and forced them to work off the clock and without breaks, according to the union. They also allege current contracts between hotels and HSS create an unfair monopoly over hotel labor.

“Every day I was told by my Hyatt manager to come in to work early and work before clocking in, and forced to work through my breaks without being paid,” Martha Gonzalez, a plaintiff in the lawsuit who used to work as a housekeeper at a Hyatt hotel through the HSS agency, said in a union press release. “I am supporting my three children and often there was not enough money in my paycheck to pay for food.”

Staffing Firm Settles Applicant Lawsuit

Integrity Staffing Solutions has settled a discrimination lawsuit brought by a job applicant convicted of aggravated assault and manslaughter 30 years ago, according to a recent Morning Call article.

The applicant, Albert Dunn, accused the firm of violating the Civil Rights Act when he was denied a job at an Amazon.com warehouse because of his criminal record. according to the article. Dunn was convicted on the charges after shooting a man who threatened him and his family.

ISS has agreed to reaffirm its equal employment opportunity for people with past criminal convictions and will re-emphasize to supervisor and personnel engaged in the hiring process the importance of appropriate review of an applicant’s criminal history, according to the article. Financial and other terms of the settlement were not disclosed.

Wal-Mart Workers Sue For Unpaid Wages

Illinois warehouse workers have accused two staffing firms of failing to adequately pay them for their hours, according to a recent Crain’s Chicago Business article.

The alleged “wage theft” occurred at a Wal-Mart warehouse in suburban Chicago. Eclipse Advantage, the staffing firm that hired the workers, was named in the suit, along with Midwest Temp Group Inc., according to the article. Wal-Mart was not named.

The workers claim they were promised to be paid minimum wage – $8.25 in Illinois – with the opportunity to earn a bonus, according to the article. However, the lawsuit says their paychecks do not reflect the actual hours worked and do not equal minimum wage.

Both temp companies are accused of violating the Illinois Day and Temporary Services Act, according to the article.
